ELL Cancellation Policy

At Elmwood Law Limited, we strive to provide our clients with the highest level of service and satisfaction. To ensure clarity and fairness, we have established the following cancellation policy:

Cancellation Within 14 Days

You have the right to cancel your instruction at any point within 14 days of the date when you signed our terms of engagement.

If you cancel within this 14-day period, no charges will be applied, and you will not incur any fees.

Cancellation After 14 Days

If instruction is terminated for any reason whatsoever, after the 14 days and prior to an offer being made, Elmwood Law Limited reserves the right to charge our Hourly Fees for work undertaken under this agreement. Such fees are calculated at six (6) minute intervals and rounded up to the nearest unit of 6 minute time-frames. For example, short or standard letters, emails and phone calls may require less than six-minutes of a fee earner’s time but will still be charged as one six- minute unit. Each six-minute unit is the equivalent of 10% of our hourly rate. Our hourly rate for work under this agreement is £60 per hour inclusive of VAT.

The Fee’s we charge if a cancellation is made after the 14 days are per individual case. Work undertaken will be costed based on the estimated or where it is possible to ascertain the exact time taken. This shall include:

  • Our telephone calls and e-mails to and from you, your lender and any other 3rd parties in respect of the claim.
  • Letters drafted to you, your lender and any 3rd parties
  • Our time spent reviewing correspondence received from you, your lender and any other 3rd parties
  • Our time spend collating Claims, appeals, and calculations
  • Any other time spend on your case.

An itemised bill will be raised for each individual case detailing the work carried out up until the point of cancellation.

Unpaid Fees
All fees are due within 10 business days, unless otherwise agreed If any fees remain unpaid , we retain the right to transfer your case to a selected debt collection agency. Please be aware that additional charges may be applicable in such instances.

We will not ask you for excessive information in order for you to cancel, however, we will need to take reasonable steps to identify you, including asking you security questions and in some instances requesting copies of ID, before we can action such requests.

Effective Date

This cancellation policy is specific to Car Finace Claims, is effective as of 27/11//2024 and applies to all engagements signed on or after this date.
